Tooth and Consequences

The temptation to make a dental pun proved too much for City of London Police when it came to reporting the results of one of their recent investigations.

The ‘tooth’ part alludes to the background of the three family members behind a complex insurance fraud.

The consequences in this case were substantial suspended sentences along with a direction for a total of 420 hours of unpaid work, to be carried out by the three culprits. This followed a four week trial. A departure from the GDC register would also seem likely.

Bozena Rak-Latos, 63, was sentenced to 24 months’ imprisonment, suspended for 24 months, and 180 hours unpaid work. Described as a former dentist, she was portrayed as having manipulated her son and daughter through a combination of professional knowledge and personal influence. She was according to the police, “the driving force, directing the operation from behind the scenes and attempting to cover her tracks when the investigation began.”

She had been erased by the General Dental Council in 2018 following a previous fraud conviction in Poland. Though not practicing, she retained control of the practice through her children and directed the fraud from behind the scenes. Evidence recovered during the investigation, including videos, audio recordings, and documents, showed her instructing her son and daughter on how to submit claims, respond to insurer queries, and conceal the fraud. When she learned police were contacting patients, she ordered the replacement of clinic computers and told her children to ensure all claimed treatments had been completed.

The fraud was carried out through BRL Dentos Ltd, trading as Diamond Dental & Medical Clinic, based in Finchley, North London. Between August 2020 and June 2021, the clinic submitted £356,587 in dental treatment claims to Simply Health, of which £141,618 was paid out. These claims were linked to 113 insurance policies set up under seven companies. Patients were falsely listed as employees of these companies to qualify for corporate dental insurance.

Kacper Latos, Bozena’s son, who registered with the GDC in June 2020, submitted inflated or fabricated claims for himself, his parents, and other purported employees, some of which were paid directly into his personal bank account and spent on groceries and personal expenses. He also persuaded patients to enrol in the scheme for £343.20 per year, often submitting claims on their behalf and redacting bank statements to mislead insurers.

Bozena’s daughter Magdalena, worked at the practice dealing with reception and marketing, and played a key role in expanding the fraud. She opened a business account for London Smile Design and used it to collect payments from patients falsely listed as employees. Magdalena frequently contacted the insurance broker to add new members and chase claims. Despite denying links to certain companies, evidence showed she managed policies and payments for several linked businesses.

HMRC records showed little declared income and no tax paid by any of the defendants during the offending period. During the same period BRL Dentos Ltd received £62,724.48 in COVID-19 grants.

Through police interviews, all three defendants maintained their innocence which consequently led them to all putting in a plea of not guilty. Following a four-week trial at Wood Green Crown Court, all three defendants were found guilty.

Kacper Latos was suspended by the interim orders committee of the GDC in July 2021, with the order most recently renewed in September 2025.
