Law firms align to help dentists denied business interruption claims justice

Leading city law firm, Mishcon de Reya, is encouraging dental businesses to join its group action against QBE following the Court’s determination that QBE1 policies should pay out for business interruption losses relating to Covid-19. Mishcon believes that many dental businesses are insured under the QBE policy wording that the High Court has ruled should have triggered cover for pandemic losses. The Group’s costs have been underwritten by Harbour, leading litigation funder so there is no fee to join the Group and all legal costs are paid by the funder.

Sonia Campbell, the Mishcon de Reya partner leading the group action against QBE, says, “We know that thousands of dental businesses have been badly impacted by the pandemic and that QBE has not paid out. Given that the High Court judgment makes clear that QBE should pay out under certain policies, we are best placed to represent UK dentists and others insured by QBE, to pursue the insurer for payments.”

Mishcon de Reya, the only law firm granted permission to intervene to represent policyholders during the recent FCA Business Interruption test case, is expanding its group action against QBE to include dental businesses who have lost out in the pandemic.

Mishcon believes that many dental businesses have responsive Business Interruption policies with identical wording to the QBE policy which the High Court has ruled should pay out (QBE1) – despite policyholders having been told that their policies are not valid. This may not be correct in light of the Judgment on September 15, and a group action remains the best way forward. Mishcon de Reya has been at the heart of disputes relating to Covid-19 Business Interruption claims. The group action is supported by Harbour, one of the world’s largest litigation funders.
