Guilty tooth whitener warns others

Ms Catherine Brophy from Torquay pleaded guilty to practising illegal tooth whitening in Devon and received a 12 month conditional discharge as well as being ordered to pay a £15 victim surcharge, and  General Dental Council (GDC) costs of £600. After the case she said: “I think it's important to warn others who might inadvertently fall foul of the legislation.”

Ms Brophy faced an unlimited fine but the magistrates noted her 'genuine remorse' and decided to impose a conditional discharge for 12 months instead. She was ordered to pay £600 as a contribution towards costs and a victim surcharge of £15.

Speaking after the hearing, Ms Brophy said: "I was so relieved at the magistrates' decision and I think it's important to warn others who might inadvertently fall foul of the legislation. I support what the GDC does as there are lots of cowboys out there who haven't even had any training. But I'm frustrated as I undertook an intensive three-day course with a bona fide organisation to obtain what I believed was a legitimate qualification. I did it four years ago because I wanted some flexible work, but home kits seem to be more popular so it wasn't that lucrative. It's strange these courses imply you can set up your own business and earn money on the back of them, but you can't practise with these courses alone. People need to look at relevant legislation if they're doing a course. It was really upsetting and embarrassing to end up in court."

In a separate case the GDC prosecuted a woman from Wakefield for carrying out tooth whitening illegally.  Janine Gilchrist pleaded guilty to unlawfully offering the treatment at Bohemia & Sisters beauty salon at 170 Kirkgate on 22 March 2016, without being on GDC’s list of registered dental professionals. A conditional discharge is a sentence passed by a court whereby no further action is taken during a set period provided that the defendant commits no more offences within that period. If they do so, they can be sentenced for the new offence and the original matter at the same time.
