Convicted dentist ordered to repay substantial sums

Birmingham dentist, Joyce Trail, who was  jailed for 7 years for stealing £1.4 million from the NHS, has been ordered by Warwick Crown Court to repay £1,376,423.83. Any assets she has now, or receives in future, up to this amount can be claimed by the NHS. She was also given a confiscation order of £358,281.87 which she must pay within 18 months.

Trail was convicted after a major fraud investigation by NHS Protect. She submitted over 7,000 false claims for payment to the NHS, for work she had not performed, including for the deceased and patients she had never met. The sentencing judge called the crime “calculated, blatant and dishonest”, adding that Trail was motivated by “pure greed”.

The confiscation order of £358,281.87 is based on what it is believed she can afford at this time given her realisable assets, identified by West Midlands Police Economic Crime Unit, which has conducted a financial investigation following her sentencing. Almost 75% of the payments made to Trail under her NHS contract were based on false claims.

NHS Protect is taking steps for her NHS pension to be forfeited. Sue Frith, Head of the National Investigation Service at NHS Protect, said: “This is the sort of outcome the public wish to see. We will always seek to recover lost NHS funds. NHS Protect and other agencies will do all we can to recoup as much of the loss as possible so it can be spent properly, on caring for NHS patients”.
