Tooth whitening court fines are increasing

Some recent court cases show variation in fines across the country, ranging from £2,000 in Birmingham to £9,000 in Derby, but overall the trend is for the amounts to be increasing. In most cases, all of which were prosecuted by the GDC, the defendants pleaded guilty, but claimed not to know they were doing wrong.
A Birmingham woman who pretended to be a dental hygienist has been ordered to pay more than £2,000 for carrying out illegal teeth whitening in a city apartment. Naomi Austin claimed she was qualified to carry out teeth whitening, but was caught out by an undercover investigator. She pleaded guilty to two charges of carrying out dentistry work without holding any dentistry qualifications and also admitted a third charge of unlawfully using the title ’dental hygienist’.
A Polish dancer who had only been in the UK for three months when she was caught illegally posing as a dentist in Hornchurch has been fined a total of £3,486. Anita Klimecka-Stankiewicz was convicted of two different charges relating to using the protected term “dentist” and practising dentistry while not registered to do so. She was charged after two undercover investigators from the GDC visited ‘Beauty Box by Maggie’, a beautician’s, which was offering tooth whitening treatments on its Facebook page.
A Derby businessman has been ordered to pay more than £9,000 by the courts for illegal tooth whitening. Harjeet Jolly, also known as Bob Jolly, was advertising a tooth whitening service online, but he claimed that he had no idea he was doing anything wrong. Jolly has told local media he was "deeply embarrassed" and "very sorry" about what has happened. He said he has been tooth whitening for many years but said he had no idea it was against the law.
Finally, Essex beautician, Alina Hijaz of Imperial Smile Beauty in Romford, has pleaded guilty to offering illegal tooth whitening and has been ordered to pay over £3,500 by Barkingside Magistrates’ Court. Following the receipt of a complaint that Imperial Smile Beauty salon had attempted to pressure an attending dentist to provide tooth whitening to an underage patient, the GDC launched an investigation, which produced evidence in Court that Ms Hijaz held herself out as being prepared to practise dentistry, in the form of tooth whitening.
