Judge named for BDA?s Judicial Review

The judge for the Judicial Review of the GDC's ARF consultation on December 15, will be the Hon. Mr Justice Cranston. The case will be heard from 10am at the Royal Courts of Justice in London. GDPUK news will report on any verdict delivered that day, together with any reaction from BDA or GDC.

Sir Ross Frederick Cranston, is a High Court judge and former Labour Party politican, he was MP for Dudley North from 1997 until not standing for election in 2005. He was born in 1948 in Brisbane, Australia. He was a Professor of Law at LSE from 2005 to 2007, then was appointed a judge in 2007.

The BDA’s chairman, Mick Armstrong writes: ‘There’s every chance we won’t get the judgement on the day. But as soon as we've got a verdict from the judge, members will be the first to know. We regret that it has come to this, that a court hearing was required to make our regulator hear the voices of the dental profession. However, in the face of their intransigence, we were left with no option but to make a stand and fight for our profession.

‘Our case is, as I'm sure you can imagine, complex. But we're fighting for a fairer deal for dentists and effective and efficient regulation. In summary, on Monday we are asking the Hon. Mr Justice Cranston to:

  • Overturn the GDC’s consultation
  • Reverse the implementation of the fee rise
  • Go on the record stating the GDC acted improperly
  • Ensure our costs are covered’

Dr Armstrong thanked members for their support and involvement. He said: ‘We could not have had our day in court without our members. We've already proved that we're stronger together. Monday is our chance to show our regulator that our voice must be heard.’
